These Terms of Sale (the “Terms of Sale” or “Terms”) apply to any order placed or purchase made through evenrealities.com (“Website” or “Store”), and govern the transaction between you and Even Realities or its affiliated entities (“Even Realities,” “EVEN,” “we,” “us,” or “our”) (collectively, the “Services”). You agree to be bound by these Terms of Sale, and you represent and warrant that you are at least 18 years old and have the legal authority to accept this Terms of Sale on your own behalf or on behalf of any party you represent. You shall be fully responsible for your activities and interactions in connection with the Services. If you are placing an order on behalf of an entity, you further represent and warrant that such entity is duly organized and validly existing under the laws of its jurisdiction of incorporation, and that you are authorized to enter into and bind such entity to these Terms of Sale.

By ordering or purchasing any product through this Website, you agree to be bound by these Terms of Sale, Terms of Service, as well as the Even Realities Privacy Policy (the “Privacy Policy”). If you do not agree to these Terms, you must not access or use the Services.

Order Confirmation / Acknowledgment of Receipt

You may add selected products to your shopping cart and complete your order by clicking the “Add to Cart” button on the applicable pages of this Website. When placing an order, you are required to provide us with all necessary information, including your name, delivery address, and billing details. If you are purchasing a product as a gift, you must also provide the recipient’s information. You represent and warrant that all such information provided is accurate, and complete. You are responsible for ensuring that your account information (including your contact and shipping information) is kept current on the Site. Even Realities shall not be liable for any inaccurate or outdated information provided by you and shall have no obligation to ascertain your correct contact or delivery details. For any order pending shipment, you may update your information at any time prior to shipment by contacting our customer service through the Contact Us page on this Website. Even Realities will not process any payment for the purchase of a product until an Order Confirmation (as defined below) has been issued.

After you place an order, you may receive a confirmation message from us indicating the expected shipping time for your order (the “Order Confirmation”). Please note that the Order Confirmation does not constitute acceptance of your order. We will confirm our acceptance of your order by sending you a communication indicating that your order has been processed and/or that the purchased product has been shipped (the “Order Acceptance”). Any delivery dates or times provided by us (or by the courier company) are estimated only and are not guaranteed. The risk of loss for the product you purchased transfers to you upon delivery of the product to you.

Launch Offer

At the time of a new product’s official launch, you may be eligible to enjoy a limited-time Launch Offer available on this Website. The Launch Offer price applicable to your purchase will be quoted to you at the time you submit your order, and such price will include any applicable taxes and shipping fees. By placing an order during the Launch Offer period, you acknowledge and agree to be bound by the rules of this Launch Offer .

Launch offer instructions

Under the rules of this Launch Offer , the main unit of the glasses released at launch (the “Main Product”) is not eligible for any discount under this offer. Products eligible for discounts are ring products and related accessories released at launch (collectively, the “Discounted Products”). The Discounted Products are available at a 50% discount, which will be automatically applied at checkout by the system. In addition, Even Realities may, based on a customer’s purchase history, issue personalized promotional offers to specific customers via email. Such offers constitute “Exclusive Benefits” and are available only to invited users. The exact content and applicable terms of such offers shall be determined by the official notification received in the customer’s account. If you are a returning customer, please check the email address used for your previous orders. If you have forgotten the email address associated with your previous orders, you may contact the Even Realities team at evenrealities.com/support and provide your historical order information. Upon verification and confirmation, you may be granted eligibility for the promotional offer.The "Exclusive Benefits" is a one-time benefit and cannot be reinstated once canceled.

Discount Quantity Limitation

During the new product launch period, there shall be no purchase quantity limitation for the Main Product. However, within each order, the maximum number of Discounted Accessories eligible for the promotional discount shall be equal to the number of Main Products purchased in that same order. If the quantity of any accessory purchased exceeds the number of Main Products, the excess quantity shall be charged at the original retail price.

Order of Discount Application

Depending on the customer’s eligibility status, different discount rules may apply to the accessories eligible for discounts within an order. Where the system confirms that you possess Exclusive Benefits, such benefits shall be applied with priority. Any remaining eligible accessories not covered by the Exclusive Benefits will continue to receive this Launch Offer (50% off). If you do not hold any personalized Exclusive Benefits, all accessories will be charged at the Launch Offer price.
Return Policy for Launch Offer Orders

If you wish to return an order placed under the Launch Offer , and such order includes any Discounted Products, you must return all related products in their entirety. If any eligible product is not returned, Even Realities shall deduct from the refund amount the corresponding cost of the unreturned product(s), calculated based on the current retail price listed on this Website at the time the return is processed.

Special Notes

The Launch Offer may be combined with the “Refer Friend” reward points.

The actual shipping date for any accepted Launch Offer order shall depend on multiple factors, including but not limited to the date of payment and Even Realities’ production schedule. No guaranteed delivery date is provided for Launch Offer orders.

Even Realities reserves the right of final interpretation of these Launch Offer Rules and retains the right, to the extent permitted by law, to amend these Terms or terminate this promotion at any time.

Refer Friend

For users located in certain designated regions, you may be eligible to receive referral reward points by participating in the Refer Friend Program. The specific rules and conditions governing the earning and use of such points shall be as set forth in the notifications within the Even Realities App. These referral reward points may be used in conjunction with the Launch Offer . However, they may not be combined with any other promotional offers or discount coupons, except where explicitly permitted. If you cancel or return an order that was purchased using referral reward points, the points applied to that transaction may not be refunded or reinstated.

Right to Reject

Prior to the acceptance of an order, we reserve the right to refuse or cancel your order. In such cases, we will notify you by email or through other reasonable means. Possible reasons for order rejection include, but are not limited to: (a) we are unable to supply the product to you, for example, because the product is no longer available or the price displayed at the time of sale was incorrect; (b) you request delivery to an address outside of our supported delivery service areas; (c) the quantity of products you ordered exceeds the maximum quantity permitted; or (d) your order has been identified by our system as a high-risk or potentially fraudulent transaction. If you have already made payment, we will refund in full the amount you paid for the rejected or canceled order, including any applicable taxes and shipping fees that were collected.

Notwithstanding the foregoing, Even Realities reserves the right, in its sole discretion and without notice, at any time and for any reason, to remove, modify, suspend, or disable access to all or any portion of the Services.

Right to Cancel

For non-prescription glasses products, you may cancel your order at any time prior to shipment and before Order Confirmation. You may request to cancel your order/service by following the instructions provided on the "Contact Us" page.

For prescription glasses products, since such products are highly customized (and specifically tailored to you), they are not eligible for the statutory “cooling-off period” or the right of withdrawal/return without cause. Nevertheless, we provide you with the right to cancel or modify your order information within 24 hours after placing it. To exercise this right, please contact us at support@evenrealities.com for assistance. After the 24-hour period, your order will enter the production process, and at that point, we will no longer be able to accommodate cancellations or modifications.

Right to Return

For non-customized products, you have the right to request a return within 14 days from the date of receipt.This right to return does not apply to the following products: Products that are clearly marked as non-returnable, including those that have been personalized or modified at your request.

All returned products must be sent back in their original packaging. You may be required to bear the shipping fees associated with returning the product to us. If the returned product, upon inspection, is found to have been used, damaged, missing components, or otherwise unsuitable for resale, Even Realities reserves the right to charge you a restocking fee or reduce the refund amount proportionate to the loss in value caused by use, damage, or missing components. If the returned product was purchased as part of a bundle, but not all products in the bundle are returned, we will refund the returned product’s value after deducting the equivalent value of the bundle discount.

If you wish to return any product, you must inform our Customer Service of your decision by following the instructions provided at support.evenrealities.com.

If a product purchased through this Website is found to be non-conforming or defective, and qualifies under our Limited Product Return Policy (the “Product Return Policy,” available at support.evenrealities.com), you may return such product to us in accordance with the procedures set forth in the Product Return Policy.

This Product Return Policy provides you with rights in addition to any statutory rights granted under the laws of your jurisdiction. If the laws of your jurisdiction provide for a longer return period or other more favorable consumer protections, such local legal provisions shall prevail.

Price and Payment

We accept various methods of payment, including credit cards, debit cards, installment payment platforms, payments made via PayPal, and other authorized payment service providers. Additional terms and conditions between you and your payment service provider may apply.

When you submit an order or pre-order, you authorize the use of the designated payment method and authorize us to charge the order amount to that payment method. By providing your payment information, you authorize us (or our third-party payment processors) to process and store your payment details and related data. We may engage agents, subsidiaries, or affiliates to handle payment processing and shipment matters on our behalf. If the payment method you have designated cannot be verified, is invalid, or otherwise unavailable, we reserve the right to suspend or cancel your order. Under such circumstances, you are solely responsible for resolving any issues arising in connection with your order. If you submit information or place an order as a guest on this Website, Even Realities and our affiliates may store such information for the purpose of processing your order, providing customer support, and, if you have opted in, for sending you marketing communications from us or our affiliates.

The prices for our products and services may vary based on your country, region, or currency. Such differences are primarily influenced by factors including local tax regulations (such as Value-Added Tax, VAT), exchange rate fluctuations, operational costs, and market conditions. The final price displayed includes all applicable taxes and fees (unless otherwise required by law) and will be confirmed on your order summary page. By completing payment, you agree to accept the price applicable to your region.

Glasses’ Prescription Lenses

By placing a Prescription Order, You warrant, represent and undertake:

That the product is for a person aged 16 years old and over, they are not registered blind or registered partially sighted or suffer from glaucoma or any other related eye disease;
That You are in possession of a written prescription that are the subject of the Prescription Order, and that such prescription has been given to You by a local registered medical practitioner or registered optometrist ("Your Optician") following the testing of sight by him or her within the last twenty-four months if You are under 70 years old, or within the last twelve months if You are aged 70 or over, and that any recommended retest date has not elapsed;
If sending Even Realities Your existing spectacles to be copied, that the spectacles sent to Even Realities are made to Your written prescription referred to in Previous Clause;
To supply, full, accurate and complete details of Your current prescription (including any notes on the prescription) or a copy of Your original prescription when requested, and any contact details as given to You by Your Optician;
That You know of no reason why the prescription services may not be suitable for Your requirements;
If You have worn spectacles or contact lenses before and have experienced any problems with the spectacles or contact lenses, to provide Even Realities with accurate and complete details of such problems.

You undertake to indemnify Even Realities in respect of all costs, expenses (including reasonable legal fees and costs), losses, damages and liabilities incurred or suffered directly or indirectly by Even Realities by reason of any breach or alleged breach of any representation, warranty or undertaking or any provision of this Agreement, except where such costs, expenses etc. arise solely out of the fault of Even Realities.

Errors

We make every effort to provide accurate product information and to eliminate any related errors; however, we do not warrant that any product descriptions, pricing information, or other content is accurate, complete, reliable, current, or error-free. In the event an error is identified, we reserve the right to correct such error and, where applicable, to revise your order accordingly (including by charging the correct price), or to cancel the order and refund any amount already collected. If we discover a pricing error or other material error in relation to a product that has not yet been shipped or delivered, we will contact you to inform you of the error and offer you the choice to proceed with the purchase at the correct price or to cancel the order. If we are unable to reach you using the contact information provided during the ordering process, we will deem the order to have been canceled.

Taxes

If your purchased product is subject to any form of use tax, sales tax, customs duty, or other governmental taxes (collectively, “Taxes”), we may collect such Taxes from you. The applicable Taxes may be displayed at checkout. You are solely responsible for all Taxes associated with your purchase of the product.

Warranty

We stand behind the quality of our products. The Product Warranty Policy form an integral part of these Terms of Sale. For details regarding the warranty terms applicable to your product, please refer to the Warranty Policy section available at support.evenrealities.com.

Data Protection

All the Personal Data collected from you is subject to applicable laws and Even Realities shall try its best efforts to protect your Personal Data. Please refer to Even Realities’ Website Privacy Policy for more information regarding the collection and use of your Personal Data (the “Privacy Policy”).

Trade Compliance

You shall comply with all applicable export control and trade sanctions laws and regulations in using our products, services, software, and technologies, including those enacted by the United Nations, the People's Republic of China, the United States, the European Union, and any other applicable jurisdictions (collectively, the “Export Laws”). By purchasing or using our products or services, you represent, warrant and undertake as follows:

(a) You are not listed on any U.S. or non‑U.S. government restricted parties list, including but not limited to the U.S. Department of the Treasury’s Specially Designated Nationals and Blocked Persons List (SDN List), the U.S. Department of Commerce’s Entity List, Denied Persons List, Unverified List, and any similar lists maintained by other jurisdictions.

(b) You are not located in, and you shall not access or use our products or services from, any country or region that is subject to comprehensive or country‑specific trade sanctions, embargoes, or restrictions under U.S. law (including the U.S. Export Administration Regulations (EAR) and the regulations administered by the Office of Foreign Assets Control (OFAC)), under the laws of the European Union, or under other applicable export control regimes.

(c) You shall not use our products or services for any purpose prohibited by Export Laws, including but not limited to the development, production, or delivery of nuclear, chemical, or biological weapons, missile technology, or any activity related to terrorism, or any other prohibited end‑use as defined under the applicable Export Laws.

(d) You shall not directly or indirectly export, re‑export, transfer, sell, resell, or otherwise dispose of our products or services (i) to any country or region subject to trade sanctions or embargoes, (ii) to any individual or entity listed on any restricted parties list, or (iii) for any prohibited end‑use, in each case without obtaining all required government authorizations.

If Even Realities determines or reasonably suspects that you have breached or may breach any provision of this Section, or that your use of our products or services poses a risk of non‑compliance with Export Laws, Even Realities shall have the right to take immediate action, without prior notice to you, including but not limited to:

terminating this Agreement and/or your account;
revoking your license to use our products;
suspending or restricting your access to the Services;
cancelling or restricting your purchases of products;
removing or disabling access to any relevant content.

Even Realities shall have no liability to you or any third party arising from any action taken in accordance with this Section. You agree to indemnify and hold Even Realities harmless from and against any losses, damages, fines, settlement amounts, attorney fees, and litigation costs incurred by Even Realities as a result of your breach of this Section.

Dispute Resolution

Any dispute, controversy, or claim arising out of or in connection with this Agreement, including any question regarding its interpretation, breach of contract, termination, or validity, shall first be resolved through amicable negotiation between the parties involved. Please refer to Even Realities’ Terms of Service for more information regarding the dispute resolution.

Additional Terms

Even Realities reserves the right, at its sole discretion and for any reason, to update this Terms of Sale. Any such revised terms shall take effect upon publication and shall not, under any circumstances, apply to sales completed prior to the date of publication.

You may not transfer these Terms or any rights granted hereunder without the prior written consent of Even Realities. Any attempt to transfer in violation of this restriction shall be null and void. Subject to the foregoing restriction, these Terms shall be fully binding upon and inure to the benefit of you and us and our respective successors and assignees, and may be enforced by us and our respective successors and assignees. All rights and obligations of Even Realities under these Terms may be freely transferred by us in connection with any merger, acquisition, sale of assets, operation of law, or otherwise.

Even Realities and its third-party service providers may, at any time and for any reason, improve and/or modify the Services, features, or pricing at their sole discretion. The Even Realities App may automatically download and install upgrades, updates, or additional features designed to improve, enhance, or further develop the Services. Even Realities reserves the right, at any time, to modify, suspend, or permanently discontinue the Services, or any part thereof, with or without prior notice. You agree that Even Realities shall not be liable to you or to any third party for any modification, suspension, or termination of the Services.

Except as otherwise provided in the Dispute Resolution section of the Terms of Service, if any provision of these Terms is held to be unlawful, invalid, or unenforceable for any reason, such provision shall be deemed severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.
